Community Property and Bankruptcy
Wisconsin is a community property state, meaning generally that both spouses are responsible for debts incurred during the marriage and both spouses own a half interest in property owned by either or both. Additionally, all of the community property belonging to both spouses goes into the bankruptcy even if only one spouse files. As a result, this can have a significant effect if only one spouse files a bankruptcy. Therefore, filing a bankruptcy for one spouse or for a divorcing couple requires careful planning in order to maximize the benefit for both spouses.
Spousal Support, Child Support and Bankruptcy
When filing bankruptcy, many unsecured debts are discharged, including credit card debt, some loans and unpaid bills. However, if the person filing bankruptcy has a court order to pay child support and/ or spousal support (alimony), or pay debts owed by both spouses, he or she is often required to continue doing so, except under certain circumstances.
