Community Property and Bankruptcy
Wisconsin is a community property state, meaning generally that both spouses are responsible for debts incurred during the marriage and both spouses own a half interest in property owned by either or both. Additionally, all of the community property belonging to both spouses goes into the bankruptcy even if only one spouse files. As a result, this can have a significant effect if only one spouse files a bankruptcy.
